The REALMONITOR Limited Liability Company (registered office: 1093 Budapest, Gálya utca 6. fszt. 1, hereinafter referred to as: Company or Data Controller) hereby informs you that the Real Estate Ads Watch mobile application (hereinafter: Apply at) (hereinafter referred to as: Users or Stakeholders) to the processing of data that occurs during the use of the Application, in accordance with the applicable international and national data protection legislation, in particular REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Regulation (EC) No 95/46/EC (General Data Protection Regulation, hereinafter referred to as the "GDPR") GDPR) and in accordance with the provisions of Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information.

The General Data Protection Regulation (hereinafter: Pursuant to Article 13 of the GDPR), we inform you of the following in connection with the processing of your personal data: (This short Privacy Notice is a short extract of the Data Controller's Privacy Policy, which is designed to provide Data Subjects with concise information on the main data protection rules of the Data Controller. For issues and topics not covered in this Policy, the Data Controller's Privacy Policy and the provisions of the applicable laws shall prevail and this Policy shall be read in conjunction with them.)

The current version of this notice is available in the login area of the Application. The Data Controller reserves the right to amend this policy at any time.

When using the Application, the User is required to provide contact details, so the source of the data is the Data Subject.

In the course of its activities in connection with the Application, the Data Controller carries out the following data processing activities, which are indicated separately for the sake of transparency, indicating the type of data processed, the purpose of the processing, the legal basis of the processing, the source of the data, the recipients of the processing and the duration of the data storage.

The Realmonitor Real Estate Search App is a mobile app that monitors and compares real estate listings, available for download from the Apple Store or Google Play Store. After downloading and opening the Application, the User can register by entering his/her e-mail address and a password, or via his/her Google/Icloud account, which are used to verify the validity of the e-mail address. In the Application, the User can define and save the search criteria (e.g. price, location, sqm...) for the properties he/she is looking for for purchase or rental purposes. Based on these, the User will receive instant notifications in the Application when the Application finds a new property on the real estate market that matches the search criteria saved by the User.

By entering his/her name and phone number in the Assistant function within the application, the User can request a free personal assistant by pressing the "Request personal assistant" button, who can help him/her with his/her specific needs (e.g.: free tools useful for searching, search for a professional (real estate consultant, renovation specialist, lawyer for sale/buy, credit advisor), etc.). The User can only use this function if he/she provides the necessary personal data, in particular his/her name and telephone number, and consents to the processing of these data for the purposes described above. Consent may be withdrawn at any time by adatkezeles@realmonitor.hu by sending a message to the e-mail address, according to which the User will not be able to use the personal assistant after the withdrawal, but otherwise the withdrawal of consent will have no further consequences. Withdrawal of consent does not affect the lawfulness of the processing that took place before consent was withdrawn.

By registering, the User acknowledges that in order to continuously improve the Application, to make it more useful for Users and to measure customer satisfaction, the Data Controller may contact the User by e-mail or by telephone at the telephone number provided by the User (if the User has provided a telephone number in his/her Profile). The User may, of course, object to further requests for this purpose on the basis of an e-mail request or during a telephone call, in which case we will not bother you with such a request again.

In connection with this data processing, the User has the following rights:

1.         Right of access to your personal data: The data subject shall have the right to obtain from the Controller feedback as to whether or not his or her personal data are being processed and, if such processing is taking place, the right to access the personal data and the information required by law. On this basis, the Data Subject therefore has the right to contact the Data Controller and request information about the processing of his or her data and access to his or her data.

2.         Right to rectification of data: In the event of a change to his or her data, the data subject may at any time request the rectification of his or her data by providing the correct data.

3.         Right to data erasure: The data subject shall have the right to obtain from the Controller the erasure of his or her data if the processing is no longer necessary for the purposes for which the data were collected, if the processing is unlawful or if the erasure of the data is required by law.

4.         Right to restriction of data processing: The data subject may request the restriction of processing if the processing is unlawful, if the controller no longer needs the data for the purpose of the processing, but the data subject wishes to use them to pursue a legal claim. Restriction of processing means that the data may only be stored until the restriction is lifted and may only be used for the purpose of making a legal claim.

5.         Right to object to processing: The data subject has the right to object to the processing of his or her personal data at any time on grounds relating to his or her particular situation. In such a case, the Data Controller shall examine individually whether there is a legitimate ground justifying the need for the processing. By deleting his/her account, the data subject (Profile menu) to initiate the deletion of the data processed about the data subject in the course of the service.

6.         Right to data portability: The data subject shall have the right to obtain from the Controller personal data concerning him or her processed by the Controller in a structured, commonly used, machine-readable format and the right to transmit such data to another controller without hindrance by the Controller. In exercising the right to data portability, the data subject has the right to request, where technically feasible, the direct transfer of personal data between controllers.

7.         Right to lodge a complaint with a supervisory authority: The data subject has the right to lodge a complaint with the National Authority for Data Protection and Freedom of Information. (Contact: 1055 Budapest, Falk Miksa utca 9-11., 1363 Budapest, Pf. 9.)

8.         Enforcement in court: The data subject shall have the right to take legal action if he or she considers that the Controller or a processor acting on his or her behalf or at his or her instructions is processing his or her personal data in breach of the provisions on the processing of personal data.

9.  Right to withdraw consent: Where the processing is based on the data subject's consent, the data subject shall have the right to withdraw his or her consent at any time, the withdrawal of consent shall not affect the lawfulness of the prior processing.

The Data Controller shall ensure the security of the data. To this end, it takes the technical and organisational measures and establishes the procedural rules necessary to enforce the applicable legislation, data protection and confidentiality rules. The Data Controller shall take appropriate measures to protect the data against unauthorised access, alteration, disclosure, disclosure, deletion or destruction, accidental destruction or damage and against inaccessibility resulting from changes in the technology used. The Data Controller shall (also) ensure the enforcement of the rules of data security by means of internal regulations, instructions and procedural rules that are separate in content and form from this Notice. When determining and applying data security measures, the controller shall take into account the state of the art and shall choose among several possible processing solutions the one which ensures a higher level of protection of personal data, unless this would involve a disproportionate effort.

Fact of automated decision-making, profiling

Please note that we do not use automated decision-making or profiling.

The app allows you to request personalised financial advice, advice on real estate transactions, or receive marketing enquiries from the app's financial partners. The availability of these services requires the explicit consent of the User, in which case the personal profile and search profile data provided by the User in the Application will be transferred to the Financial Partners in order for the Financial Partners to prepare a personalized offer. The Financial Partners process the User's personal data as a separate controller in the course of providing its services. Next to the checkbox indicating consent, the User will be directed to the list of Financial Partners and through it to their Privacy Policy, which will inform him/her about how Financial Partners, as independent data controllers, process his/her personal data. The User gives his consent to the financial partners to "Profile" in the "Profile" menu.

With the functions available in the "I want to buy a property", "I need money", "I want to renovate" and "Knowledge base" submenus of the in-app menu, the User can navigate to other websites and other service providers' interfaces, according to his/her needs and choice. The service providers available through these links (Financial Partners, JóSzaki Ltd.) process the User's personal data as independent data controllers in the course of providing their services, and act in accordance with their own data management information.
